1. General Provisions
These Terms and Conditions define the rules for using iPomagaj.pl. The Platform is operated by BITS, Warsaw, Polska, contact: contact@ipomagaj.pl.
By using the Platform or creating an account, the user accepts these Terms and Conditions.
2. Definitions
- Platform – the iPomagaj.pl online service and its related functionalities.
- User – any person using the Platform, regardless of account type.
- Seeker – a user looking for support or help from another user.
- Provider – a user offering support or services within the categories made available on the Platform.
- Account – an individual user’s access to registered Platform functions after sign-up and login.
- Services – support or assistance presented by users through the Platform, not services provided directly by the Platform operator.
3. Nature and Role of the Platform
- iPomagaj.pl enables contact between Seekers and Providers.
- The Platform acts as an intermediary and communication tool.
- The Platform does not directly provide care, household, transportation, medical, nursing, or other services performed by users.
- The Platform is not a party to agreements concluded between users.
- Any arrangement regarding scope, timing, pricing, or performance of services is made directly between the Seeker and Provider.
4. User Accounts
- Users must provide accurate, current, and complete information.
- Users are responsible for keeping their login credentials confidential and secure.
- Users must not allow unauthorized use of their accounts.
- The Platform may refuse, suspend, or remove accounts that violate these Terms or create legal, abuse, or security risk.
5. Providers and Service Information
- Providers are responsible for the truthfulness of their profile information and communications.
- Providers must not claim licenses, qualifications, certifications, or professional status unless they are valid and current.
- The Platform does not verify professional licenses in this phase.
- Service categories are intended as general support categories and do not imply medical, nursing, or other regulated professional services unless expressly stated otherwise in future versions of the Platform.
6. Seeker Responsibility
- Seekers are responsible for evaluating whether a Provider is suitable for their needs.
- Users should exercise reasonable care before arranging any in-person meeting or service.
- Users should not share unnecessary sensitive personal information through the Platform.
7. User Interactions and Agreements
- All arrangements concerning scope, timing, payment, and performance are agreed directly between users.
- The Platform does not supervise service performance and does not guarantee the quality or outcome of any interaction.
- Users are solely responsible for their communications, arrangements, and conduct.
8. Prohibited Use
Users must not:
- use the Platform for illegal purposes,
- provide false, incomplete, or misleading information,
- harass, threaten, discriminate against, or abuse other users,
- attempt fraud or misuse another person’s identity,
- collect, exploit, or disclose other users’ personal data without a legal basis,
- upload malicious code, interfere with platform security, or disrupt Platform operation.
9. Payments and Paid Features
- If paid features, subscriptions, or monetized functions are introduced later, additional payment terms may apply.
- Current free or paid availability of Platform features may change with notice.
- Payment-provider specific terms may also apply to relevant transactions.
10. Availability and Changes
- The Platform may be developed, modified, suspended, limited, or discontinued.
- The Platform does not guarantee uninterrupted, error-free, or permanent availability of all functions.
11. Account Suspension and Termination
- The Platform may suspend or terminate accounts in cases of breach of these Terms, abuse, fraud risk, legal risk, or security concerns.
- Users may request deletion of their accounts, subject to applicable retention obligations and legitimate security needs.
12. Liability
To the fullest extent permitted by Polish law, the Platform is not liable for user conduct, the quality or outcome of services, damages arising from user interactions, or inaccurate information supplied by users.
Nothing in these Terms excludes liability that cannot be excluded under mandatory law.
13. Complaints and Contact
Complaints relating to Platform operation may be submitted to contact@ipomagaj.pl. A complaint should include the user’s email address, a description of the issue, and relevant details.
Complaints will be reviewed within a reasonable time, taking into account the nature of the matter.
14. Privacy and Cookies
- Personal data processing is described in the Privacy Policy made available on the Platform.
- Cookie use and consent for necessary and optional cookies are handled through the cookie banner and settings.
15. Governing Law
These Terms are governed by Polish law. Mandatory consumer protections, if applicable, remain unaffected.
16. Final Provisions
The Platform may update these Terms from time to time. The current version and last updated date are shown on this page.
